Wayne D. Taylor and Sarah M. MacKimm successfully obtained the dismissal of a bad faith claim in a lawsuit against Landmark American Insurance Company in the United States District Court for the Southern District of Alabama. The case involved a claim for insurance proceeds for damage purportedly caused by Hurricane Sally. Landmark asserted that much of the claimed damage resulted from causes that are excluded from coverage under the policy. The Court granted Landmark’s motion for summary judgment on the insured’s bad faith claim, finding Landmark possessed a reasonable and arguable basis for contesting the amount of the covered damage.
