Wayne D. Taylor and Sarah M. MacKimm, along with co-counsel from Chicago, successfully obtained a judgment finding no coverage under two management liability insurance policies issued by The Hanover Insurance Company in the Superior Court of Gwinnett County, Georgia. The action arose out of a claim brought by a company against the insured and former employees for unlawfully taking and using the company’s trade secrets and confidential information. Hanover asserted that no coverage was provided to the insured and former employees, among other reasons, due to an exclusion precluding coverage for claims arising out of an employment relationship, including an employment-related wrongful act. The court found the employment exclusion unambiguously precluded coverage for the company’s claim against the insured and former employees and granted Hanover’s motion for judgment on the pleadings.
